All Funky snowboard products have a 1 (one) year warranty against manufacturing defects, starting from the date of purchase at an authorized Funky retailer. In addition, this warranty only covers material and manufacturing defects. The warranty does not cover normal wear and tear, excessive abuse or improper use on surfaces other than snow, impacts due to steering problems, aesthetic problems or consequent to modifications made, dents or chipping of the top sheet, the lightening of the graphite due to sun exposure, edge oxidation, rust and edge damage caused by improper mounting of the bindings.
The warranty is valid only for the original purchaser and is void if the product has been purchased by another person or from an unauthorized reseller (e.g. eBay, etc.). Make sure to keep a copy of the original receipt or invoice (proof of purchase), in the event that a service covered by warranty is required.
If the original proof of purchase cannot be provided for a warranty return, Funky snowboards will use the manufacturing date as the beginning of the warranty period.
– The products will be repaired or replaced if, following the inspection at the Funky Snowboard Service Center, they have been found to be defective in materials or workmanship.
– In the event that an exact replacement of the product is no longer available (model, size and / or color), we will replace the product with one that guarantees a comparable performance, size and value. This also applies to spare parts.

GENERAL TERMS AND CONDITIONS
1.1 These General Terms and Conditions, Consumers, apply to all legal relationships formed through the online shop www.funkysnowboards.com between the company ‘Funky snowboards s.n.c. di Isacco Mantegazza and Luca Cozzi, Via Molino delle Armi, 15 – Milan (MI), 20123, Italy, and its customers. We refuse any deviating contractual provisions of the customer specified in the order. These do not constitute an integral part of the contract, even if we do not expressly specify this at the time of acceptance of the contract.
1.2 The General Terms and Conditions apply in the version applicable at the time of conclusion of the contract. They are available at any time at www.funkysnowboards.com and can be stored free of charge by downloading and/or printing them.
2. Conclusion of the contract
2.1 The information about the goods on www.funkysnowboards.com does not constitute a binding offer by Funky snowboards s.n.c. but an invitation to the customer to submit to Funky snowboards s.n.c. an offer for the purchase of goods in the Funky snowboards online shop. To purchase the desired goods, the customer clicks on the appropriate buttons (e.g. “Get”) and enters the required information later on the order page.
2.2 The customer must have the opportunity to view all information before placing a binding order and to correct any errors. Before placing an order, customers are obliged to accept Funky snowboards’ General Terms and Conditions of Use; this information as well as the revocation information will be available to the customer for viewing and, if necessary, downloading and/or printing prior to acceptance. The subsequent submission of a binding order (e.g. “Binding order” button) constitutes a binding offer by the customer to Funky IN ENGLISH MISS Y snowboards for the purchase of the goods.
2.3 Funky snowboards s.n.c. may accept the order by e-mail to the customer within three working days (Monday to Friday, except on public holidays) or may declare tacit acceptance by sending the goods. If the customer does not receive an order acceptance e-mail and the goods are not received within 14 days of the order, no contract has been formed.
2.4 Funky snowboards s.n.c. must inform the customer by e-mail in case of delays in delivery and the duration of such delays and unavailability of ordered goods. The customer will no longer be bound by the order or can respond to confirm acceptance of the next delivery.
3. Prices, shipping and place of delivery
3.1 The current gross prices (including VAT) applicable at the time the order is placed and the shipping costs shown next to the respective goods and subsequently in the shopping cart shall apply.

3.2 The goods must be shipped to the delivery address indicated in the order. We regret that shipping to countries from those included in the list of shipping costs is not possible.
4. Shipping costs per return in case of revocation
If the customer revokes the contract, the costs of the return shipment will be paid by the customer, provided that the goods are delivered as ordered.
5. Dispatch, transfer of risk, retention of title
5.1 The goods must be shipped to the delivery address specified by the customer. Goods that Funky snowboards has in stock must be shipped within 2-5 working days.
5.2 Shipment of the goods must be at Funky snowboards’ risk. The risk of accidental loss and accidental deterioration of the goods is transferred to the customer upon delivery. This does not apply to the transport of returned goods, which must be at Funky snowboards s.n.c.’s risk.
5.3 The goods remain the property of Funky snowboards s.n.c. until full payment of the purchase price is received.
6. Customer rights in case of defects
6.1 A warranty is provided in accordance with the statutory provisions, except for limited liability for damages in cases of intent and gross negligence.

7. Liability of Funky snowboards s.n.c.

7.2 Funky snowboards s.n.c. is not liable for ordinary negligence, unless essential contractual obligations of Funky snowboards s.n.c. are affected. (The term “essential contractual obligations” means those obligations whose fulfillment constitutes a breach of contract.
The customer’s right of set-off only applies when the customer’s contractual claims have been finally determined by a court of law or are undisputed by Funky snowboards s.n.c.
9. Revocation clause
9.1 Right of revocation
You have the right to revoke this contract within 30 days without giving reasons. The 30-day revocation period will begin on the day you or a third party appointed by you, which is not the carrier, takes possession of the final goods included in the respective order. To exercise your right of revocation, you must notify [email protected] of an unequivocal statement indicating your decision to revoke this contract.
You will be deemed to have met the deadline for revocation if notification of the exercise of your right of revocation is sent before the revocation period expires.
Consequences of revocation
If you revoke this contract, we will refund all payments we have received from you, including shipping costs (except for any additional costs incurred due to a delivery option other than the cheaper standard option offered by us), without delay and at the latest within 30 days of receipt of notice of revocation of this contract. We will use the same payment method used in the original transaction to provide the refund unless we have expressly agreed otherwise; in no event will you be charged any costs relating to this refund. We may refuse to provide the refund until we have received the goods or until you have provided proof of dispatch of the goods, whichever comes first.
